Terms of Use
The agreement between you and Plumb. What Plumb is, what it is not, how billing and cancellation work, and your rights.
DRAFT — for attorney review. Not legal advice. This document is a working draft prepared to be reviewed and finalized by qualified counsel before publication. It is not legal advice and is not a final, binding agreement.
These Terms of Service ("Terms") are a binding agreement between you ("you" or "your") and Plumb Finance Inc., a Wyoming corporation ("Plumb," "we," "us," or "our"). They govern your access to and use of the Plumb website at plumbfinance.com, the Plumb mobile and web applications, and the related services we provide (together, the "Service").
Please read these Terms carefully. They include important provisions about how your subscription auto-renews (Section 6), how disputes between you and Plumb are resolved in court, not arbitration (Section 17), and limitations on our liability to you (Sections 14–15).
Counsel note: Confirm clickwrap implementation — these Terms should be accepted via an affirmative "I agree" action at signup (a checkbox or button), not merely linked in a footer, for enforceability. Retain a record of each user's acceptance (timestamp, version, IP).
1. Acceptance of these Terms
By creating an account, starting a free trial, subscribing, or otherwise accessing or using the Service, you agree to these Terms and to our [Privacy Policy], [Cookie Policy], [GLBA Privacy Notice], Acceptable Use Policy, and E-SIGN Consent, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
If you are accepting these Terms on behalf of another person or an entity, you represent that you have authority to bind them, and "you" refers to that person or entity.
2. Eligibility
To use the Service, you must:
- Be at least 18 years old;
- Be a resident of the United States with a U.S. mailing address;
- Have the legal capacity to enter into a binding contract; and
- Not be barred from using the Service under applicable law.
The Service is not directed to and not intended for anyone under 18, and we do not knowingly collect information from minors. If we learn that someone under 18 has created an account, we will close it.
3. What Plumb is — and what it is not
Plumb is a financial-wellbeing subscription service. Depending on your subscription tier, the Service may include:
- An AI money coach that helps you understand your finances and offers general educational information, prompts, and suggestions;
- Cash-flow and net-worth tracking;
- Connections to your financial accounts through our open-banking aggregator (see Section 5); and
- For some tiers, optional sessions with a human financial counselor (see Section 4).
Important — Plumb provides education, not advice. Plumb is for general educational and informational purposes only. Plumb is NOT investment advice, legal advice, tax advice, or accounting advice, and nothing in the Service is a recommendation to buy, sell, or hold any security or to pursue any particular financial, legal, or tax strategy. Plumb is NOT a registered investment adviser, broker-dealer, bank, lender, credit-repair organization, consumer reporting agency, debt-management company, law firm, or accounting firm, and we do not act as a fiduciary to you. Our AI money coach and our human financial counselors provide general financial education and coaching — not personalized investment, legal, or tax advice tailored to your situation as those terms are used under applicable law. You are solely responsible for your own financial decisions. Before acting on anything you learn through the Service, consider consulting a licensed professional (such as a registered investment adviser, attorney, or CPA) about your specific circumstances. We do not guarantee any particular financial outcome, including any change to your savings or debt, except as expressly stated in the limited outcome guarantee described in Section 8.
4. Human financial counseling (certain tiers)
Higher subscription tiers include a set number of sessions per year with a human financial counselor (for example, a Certified Financial Planner (CFP®) or Accredited Financial Counselor (AFC®)), as described on our pricing page. These sessions are educational coaching sessions. The counselor:
- Provides general financial education and coaching, not personalized investment, legal, or tax advice, and does not act as your fiduciary, investment adviser, attorney, or accountant;
- Does not sell you financial products, recommend specific securities, or earn commissions or referral fees for steering you to any product; and
- Cannot guarantee any specific result.
Sessions not used within your subscription period expire at renewal and have no cash value unless we state otherwise.
Counsel note: Confirm the regulatory status and licensing of counselors and whether any state-specific financial-counselor registration applies. Confirm session rollover/expiry treatment is consistent with the pricing page and auto-renewal disclosures.
5. Connecting your financial accounts (open banking)
You may connect your bank and other financial accounts to Plumb. We provide this connection through Array, our third-party open-banking aggregator, and its data providers.
- When you connect an account, you authenticate directly with your financial institution or through Array — Plumb never receives or stores your bank login credentials (such as your username and password).
- Your use of the connection feature is also subject to Array’s end-user terms and privacy policy, available at array.com/legal, which you should review. Array and its data providers are independent third parties, and we are not responsible for their services, availability, or accuracy.
- By connecting an account, you provide your written instructions and consent for Plumb, acting through Array as our account aggregator, to access, retrieve, and use your account and transaction data from the institutions you connect, for the purpose of providing the Service to you. You can withdraw this consent at any time by disconnecting the account in your settings.
- You represent that you are an authorized user of any account you connect.
- Account data may be delayed, incomplete, or inaccurate for reasons outside our control. Always verify important information directly with your financial institution.
You can disconnect a linked account at any time in your settings.
6. Subscription, billing, and automatic renewal
This section describes recurring charges and automatic renewal. Please read it carefully. A plain-language summary is also available at Billing & Cancellation, but these Terms control.
6.1 Plans and prices
Plumb is offered in three subscription tiers, billed monthly:
| Tier | Monthly price |
|---|---|
| Plumb | $14.99 / month |
| Plumb+ | $24.99 / month |
| Plumb Premier | $34.99 / month |
Current prices and tier features are shown at checkout and on our pricing page. Prices are in U.S. dollars and exclude any applicable taxes, which may be added.
6.2 Free trial and conversion to paid
We offer a 7-day free trial. Here is exactly how it works, and you will see this clearly disclosed before you provide payment information:
- You provide a payment method when you start the trial.
- Unless you cancel before the trial ends, your free trial will automatically convert to a paid, auto-renewing subscription at the end of the 7-day period, and we will charge your payment method the price of the tier you selected.
- We will tell you the date your trial ends and converts, and the price that will be charged, before you start.
- You can cancel any time during the trial at no charge (see Section 7).
6.3 Clear disclosure and your separate consent to recurring charges
Before you are charged, and adjacent to the payment button, we present a clear and conspicuous disclosure of: the recurring price; the billing frequency; the fact that your subscription automatically renews and continues until you cancel; the trial-conversion date and amount (if applicable); and how to cancel.
You provide separate, affirmative consent to the recurring charge — a dedicated action specific to the auto-renewing subscription — that is distinct from your acceptance of these Terms. We retain a record of your consent for at least three (3) years (or longer where required).
6.4 How renewal works
- Your subscription renews each month on your billing date.
- Each renewal continues until you cancel, and you authorize us (and our payment processor) to charge your payment method automatically for each renewal term at the then-current price for your tier.
- You authorize us to update your payment method information using account-updater services your card network may provide, so renewals are not interrupted.
6.5 Reminders
We will send you reminders by email, including a reminder before your free trial ends and converts to paid. We may also notify you before any price change with the notice required by law, and your continued subscription after the change takes effect constitutes acceptance of the new price; if you do not agree, you may cancel before the change takes effect.
6.6 Confirmation
After you subscribe or convert from a trial, we send a confirmation restating the key terms — what you signed up for, the price, the renewal cadence, and how to cancel.
Counsel note: Build to ROSCA and California's amended Automatic Renewal Law (eff. July 1, 2025) as the national baseline, since the FTC "Click-to-Cancel" rule was vacated (8th Cir., July 8, 2025). Confirm the checkout UI: unavoidable near-CTA disclosure, separate auto-renewal consent capture, ≥3-year consent recordkeeping, trial-ending reminder workflow, and any state-specific advance-notice/price-change rules.
7. Cancellation — as easy as signing up
You can cancel your subscription at any time, online, using the same easy, self-serve method you used to sign up — directly in your Plumb account settings or app, in a few clicks. We will not require you to call us, chat with a retention agent, or clear hurdles to cancel. You may also cancel by emailing support@plumbfinance.com.
- If you cancel during your free trial, you will not be charged.
- If you cancel a paid subscription, your cancellation takes effect at the end of your current paid billing period, and you keep access until then. We do not provide partial-period refunds except as described in Section 8 or as required by law.
8. Refunds and the Plumb Premier money-back outcome guarantee
8.1 General refund policy
Except for the outcome guarantee below, the free-trial mechanism, and any rights you have under applicable law, subscription fees are generally non-refundable, and cancelling stops future charges but does not refund the current period. We may, at our discretion, grant refunds in individual cases (for example, an obvious billing error).
If a charge from us does not look right, please contact us before disputing it with your bank or card issuer. A refund from us is faster than a chargeback, and we do not argue about honest mistakes — write to support@plumbfinance.com and we will look into it promptly. You keep every right you have under the Fair Credit Billing Act and any other applicable law to raise a billing-error dispute with your card issuer; contacting us first is a preference, not a condition.
No double recovery. If a charge is reversed through a chargeback or other payment-network dispute, that reversal satisfies any refund we would otherwise owe for the same charge. We will not issue a separate refund on top of a reversed charge.
Repeated abuse. We may suspend or close an account used to file fraudulent or repeated meritless payment disputes, and we may respond to any dispute with evidence of your signup, consent, and use of the Service.
Counsel note: deliberate decision — no chargeback-fee recovery or dispute-penalty language (FCBA billing-error rights; enforceability; brand posture). Confirm the offset and abuse-closure wording, and that nothing here could be read as discouraging lawful billing-error disputes.
8.2 Plumb Premier outcome guarantee
The top tier, Plumb Premier, includes a limited money-back outcome guarantee. The full material terms are below. Please read them carefully — the guarantee is conditional, and all of these conditions apply.
- Who is eligible. Only active subscribers to the Plumb Premier tier. The guarantee does not apply to the Plumb or Plumb+ tiers.
- What is guaranteed (the outcome). [DESCRIBE THE SPECIFIC, OBJECTIVELY MEASURABLE OUTCOME — e.g., "achievement of a stated savings/debt-reduction goal you set in the Service." The outcome must be objective and verifiable.]
- How the outcome is measured and verified. The outcome is measured [using the metric and data source named above, as reported within the Service], comparing your starting baseline (captured at the start of your qualifying period) to your ending measurement (captured at the end of the qualifying window). [SPECIFY EXACTLY.]
- Qualifying window. You must remain a paying Plumb Premier subscriber continuously for the [12-month] qualifying period, measured from [your first paid Premier billing date].
- What you must do to qualify (your obligations). To be eligible, you must, during the qualifying period: [e.g., keep at least one financial account connected; complete your onboarding plan; attend the human-counselor sessions included in your tier; and follow the plan's core recommended actions]. [SPECIFY THE REQUIRED ACTIONS OBJECTIVELY.]
- How and when to claim. Submit a refund request to support@plumbfinance.com within [30] days after the end of the qualifying period. We will verify eligibility against the conditions above.
- What is refunded. If you qualify, we will refund [the Plumb Premier subscription fees you paid during the qualifying period] [STATE EXACTLY: full price for the period? net of taxes? excluding any add-ons?].
- Refund mechanism and timeline. Approved refunds are issued to your original payment method within [30] days of approval.
- Exclusions. The guarantee does not apply where the outcome was not achieved due to factors outside Plumb's coaching — for example: [failure to follow the plan or attend sessions; inaccurate account data outside our control; or your closing/disconnecting required accounts]. [SPECIFY.] One guarantee claim per subscriber. The guarantee is void where prohibited and does not limit any non-waivable rights you have under law.
Counsel note: Every bracketed item in 8.2 must be made concrete and substantiated before launch. Per FTC Guides for the Advertising of Warranties and Guarantees (16 CFR Part 239) and FTC Act §5, all material conditions must be disclosed clearly, prominently, and at the same time/place as any "money-back guarantee" claim on the marketing site — and must mirror this section. Avoid any framing that promises or implies credit "repair"/"improvement" in a way that could trigger CROA; coordinate the outcome definition with the marketing-review process.
9. Account registration and identity verification
You must register an account to use the Service. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account, and you agree to notify us promptly at support@plumbfinance.com of any unauthorized use.
To open or maintain your account, and to comply with law and our vendors' requirements, we (and our service providers) may verify your identity, including by checking the information you provide against third-party databases. By registering, you authorize these verification checks. We may refuse, suspend, or close any account at our discretion, including if we cannot verify your identity.
10. Electronic communications (E-SIGN)
The Service is provided online, and we deliver agreements, disclosures, notices, and other communications to you electronically. By using the Service you consent to receive these communications electronically, as described in our E-SIGN Consent, which explains your right to receive certain records on paper, how to withdraw consent, and the hardware and software you need. Your consent to electronic delivery is required for us to deliver certain legally required disclosures (including GLBA notices) to you online.
11. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which prohibits, among other things, unauthorized access, scraping and automated access, reverse engineering, security circumvention, fraudulent account linking, and unlawful use. Violating the Acceptable Use Policy is a breach of these Terms.
12. Intellectual property and your content
12.1 Our IP and your license to use the Service
The Service, including all software, text, designs, logos, and content we provide (excluding your content), is owned by Plumb or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal, non-commercial financial-wellbeing purposes. We reserve all rights not expressly granted.
12.2 Your content
You may provide information, messages, free-text questions to the AI coach, goals, notes, and other materials ("Your Content"). You retain ownership of Your Content. You grant Plumb a worldwide, non-exclusive, royalty-free license to host, store, process, and use Your Content solely to operate, provide, secure, and improve the Service for you, and as otherwise described in our Privacy Policy. You represent that you have the rights to provide Your Content and that it does not violate any law or third-party right.
Your Content is not used to train third-party AI models. Where we send Your Content to an AI subprocessor to power the Coach, we do so under a written agreement that contractually prohibits the subprocessor from using it to train or improve its general-purpose models.
13. Third-party services
The Service relies on and links to third parties, including Array (open banking), our AI provider(s), and our payment processor(s). Your use of those services may be governed by their own terms and privacy policies. We do not control and are not responsible for third-party services, their content, accuracy, or availability. Your dealings with third parties are solely between you and them.
14. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INFORMATION (INCLUDING ACCOUNT DATA) WILL BE ACCURATE, COMPLETE, OR TIMELY. WE DO NOT WARRANT OR GUARANTEE ANY FINANCIAL RESULT, INCLUDING ANY CHANGE TO YOUR SAVINGS OR DEBT, EXCEPT FOR THE LIMITED OUTCOME GUARANTEE EXPRESSLY STATED IN SECTION 8. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PLUMB AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FINANCIAL LOSSES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Plumb and its members, officers, employees, and agents from and against any claims, damages, losses, and reasonable expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the Service, (b) your violation of these Terms or applicable law, or (c) your violation of any third-party right. We will notify you of any such claim and may participate in its defense.
17. Dispute resolution
Plumb does not require you to arbitrate. If we cannot work something out between us, either of us can take the matter to a real court — including small claims court where the claim qualifies.
17.1 First, tell us about it
Before filing suit, the complaining party will send a written Notice of Dispute describing the claim and the relief sought: if from you, to legal@plumbfinance.com and 30 N Gould St Ste N, Sheridan, WY 82801; if from us, to your account email. The parties will then try in good faith to resolve the Dispute for 60 days from the date of that notice. This informal step is a condition precedent to filing suit.
Counsel note: Confirm that the tolling / statute-of-limitations treatment during the 60-day informal-resolution window is drafted in a way that does not unfairly prejudice either party.
17.2 Small claims first
Either party may bring a qualifying claim in small claims court in the county where the consumer resides (or in any other court of competent jurisdiction where the small-claims court cannot hear the matter). Nothing in this section prevents you from reporting concerns to a government agency.
17.3 Court and governing law
For any Dispute not resolved informally and not brought in small claims court, you and Plumb consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Wyoming. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. These choices do not deprive you of the protection of mandatory consumer-protection laws of your state of residence, which continue to apply.
Counsel note: Mandatory consumer-protection law (state ARLs, UDAAP, etc.) applies based on the consumer's location regardless of this clause.
Counsel note: class-action waiver removed with the arbitration provision — standalone waivers outside arbitration are generally unenforceable; confirm whether any narrowed version is worth including.
17.4 Severability
If any part of this Section 17 is found unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest of this Section 17 will remain in effect.
18. Term, suspension, and termination
These Terms apply while you use the Service. You may stop using the Service and cancel at any time (Section 7). We may suspend or terminate your access, with or without notice, if you breach these Terms or the Acceptable Use Policy, if required by law or our vendors, or to protect the Service or other users. On termination, your license to use the Service ends; Sections that by their nature should survive (including 8, 12–17, 19–20) survive.
19. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in the app) and update the "Last updated" date. Changes take effect on the date stated in the notice. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and cancel.
20. General
- Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the rest remains in effect.
- Assignment. You may not assign these Terms without our consent. We may assign them, including to an affiliate or in connection with a merger, acquisition, or sale of assets. Your Plumb account may also be assigned or transferred at any time without notice, so long as there is not a material change to the Service provided to you.
- No waiver. Our failure to enforce a provision is not a waiver.
- Entire agreement. These Terms and the documents incorporated by reference are the entire agreement between you and Plumb regarding the Service.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
